Please read these terms and conditions (Terms) governing your use of the StatVista website (Site). By accessing the Site you accept these terms in their entirety and agree to be bound by them. If you do not accept these Terms, you should not proceed to use the Site.
We may update these Terms from time to time without notice to you, and you should therefore review our Terms whenever you visit our Site. They were last reviewed on 11 September 2008.
1 Availability of the Site
Despite our utmost efforts to provide you with access to our Site at all times, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. We also make no promise that our Site will meet your requirements or is free from faults. We also reserve the right to temporarily suspend all or any part of the Site to allow for repairs, maintenance or the introduction of new content or facilities.
2 Content
Since the content on the Site is provided to us from various third parties we cannot and do not warrant or guarantee that the content is accurate, complete, up to date or reliable. On this site you will be offered automatic links to other sites which we hope will be of interest to you. We do not accept any responsibility for or liability in respect of the content of those sites. All information provided is of a general nature and is not intended to address a specific question or problem. You should not rely on or use any content without using your own judgement, or if you are not a professional, without seeking appropriate professional advice.
3 Advertising and Sponsorship
Some parts of the site contain advertising and sponsorship. Advertisers and sponsors are themselves alone responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

The rights in material on this site are protected by international copyright, software and trademark laws and you agree to use this site in a way which does not infringe these rights. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on our site without our written permission.
5 Liability
Because the site is provided free of charge to you, we accept no liability for any loss (whether direct, indirect or incidental to the main loss or damage, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the site and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. Our liability is not limited in the case of death or personal injury directly caused by our negligence. Your statutory rights (if any) are not affected.
You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of this site.
6 Recruiter Section
You confirm that this is for business use.
6.1 Liability for content
You are solely responsible for any information submitted by you to this site. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trade mark or other intellectual property rights of any person in any jurisdiction. You are also responsible for ensuring that all information, data and files are free of viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to this site.
We also reserve the right to suspend your use of the Site immediately and without notifying you if we reasonably believe that you are using the Site in any manner that is inappropriate or otherwise in breach of these Terms.
6.2 Security and Passwords
In order to insert jobs on this site, you must first register with this site and to sign in when you visit the site, you will need to use a user name and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. You must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorised way. We accept no liability for any unauthorised or improper use or disclosure of any password.
6.3 Prices and Payment
Prices and payment are for company users only and are not applicable to private users. Job listings on our website will made available to you once your payment has been authorised. There will be no contract of any kind between you and us unless and until you make authorised payment for a job listing.
The fee for the service is as follows:
One job listing for 28 days = 250.00 Euros;
One job listing for 14 days = 150.00 Euros.
All prices are exclusive of VAT payable unless otherwise stated. VAT is charged if your account registration details state that you are resident in Germany or in the EU without a valid VAT number. In this case VAT at 19% is charged. Residents of all other countries are not charged VAT. In this respect, you hereby acknowledge that your account details regarding the country of residency are correct. Failure to provide correct account details may result in us charging you VAT at a later date and we may also decide to terminate your account.
By making payment by credit/debit card you confirm to us that you are authorised to do so, either on your own or your employer's behalf. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. All credit card service transactions are supplied by Worldpay.com.
6.3.1 Refund Policy
At any point up until authorisation by us of your job listing, we may decline to supply the service to you without giving any reason. If paid for, we may still decline to display your job listing on our website if the content is not deemed suitable for the website and its visitors. Should we decline, you will receive a refund on your payment. Once the job listing is authorised and displayed on the site, there will be no possibility of a refund. Should, for any reason, it not be possible to continue displaying the job listing, refunds may be given at the discretion of the management.
6.4 Job Listing Content
When submitting a job listing you must adhere to the following conditions:
- not reveal any confidential or sensitive information;
- not post material that includes, or links to, any unlawful, abusive, threatening, objectionable, discriminatory, defamatory or indecent material or material which is deliberately intended to upset other users;
- not post any material which you do not have permission to use (including material which may be protected by copyright, trade marks, database rights or any other form of intellectual property right);
- ensure material contains no viruses or any other components that may harm the StatVista website or other third party websites;
- not, directly or indirectly, impersonate any person
- if you are an employment agency or business) comply with the appropriate Employment Agency Standards. - comply with our Policy ;
You are solely responsible for the content of the job listing that you submit. Job listings must be current open positions for a job. We will delete any listing that we reasonably believe is not genuine.
Whilst we do not control the submission of material, we may, at our sole discretion, amend, edit or delete any material submitted by you that does not comply with these terms and conditions and any applicable laws. No refund or compensation will be given if a posting is amended or deleted for this reason.
6.5 Using this Service
Because of the nature of the Internet, errors and omissions do occur and except as expressly set out in these terms and conditions, we do not give any other warranties in respect of the service.
6.6 Your Liability to Us
You will compensate us fully (including legal costs) for all losses we suffer relating to a claim by a candidate or any third party as a result of your breach of these terms and conditions or any applicable law.
6.7 Our Liability to You
If we are in breach of these terms and conditions, we will only be responsible for any losses that you suffer as a result, and to the extent, that they are a foreseeable consequence to both of us at the time you first submit a job listing. Our liability in that respect shall be limited to the amount of fees paid by you to us for job listings, which you cannot use because of our breach of these terms and conditions.
Our liability to you shall not include indirect or consequential loss or business losses such as lost data, lost profits or business interruption.
This clause shall not limit or affect our liability if something we do negligently causes death or personal injury or if we commit fraud.
6.8 Termination of the Service
We reserve the right to terminate or suspend your use of the service without notice if you are in breach of these terms and conditions.
7 Statistical Jobs Section
7.1 Contact between you and your potential employer
The jobs section of the site is made available by us solely for the purpose of allowing users to search for statistical jobs advertised by recruiters. You are responsible for making the application with the recruiter. We will not make contact on your behalf.
7.2 Accuracy of information
Any contact between you and the recruiter will be direct and will not involve StatVista in any way other than providing the recruiter's contact details. We will not be responsible for any loss or damage that you may incur after contacting the recruiter.
We do not check the reliability nor do we check accuracy of the information that recruiters place on this site. Therefore, you acknowledge and agree that we are not liable for any information provided by the recruiter.
7.3 Liability for content
You are solely responsible for any information submitted by you, through StatVista, to the recruiter. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trade mark or other intellectual property rights of any person in any jurisdiction. You are also responsible for ensuring that all information, data and files are free of viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to this site.
We also reserve the right to suspend your use of the Site immediately and without notifying you if we reasonably believe that you are using the Site in any manner that is inappropriate or otherwise in breach of these Terms.
8 Personal Data
By using our Site you are agreeing to the collection and use of your personal data as set out in our Privacy Policy.
9 General
You may not assign, sub-licence or otherwise transfer any of your rights under these Terms.
If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
If you breach these Terms and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.
We shall not be responsible for any breach of these Terms caused by circumstances beyond our control.
It is not intended that a person who is not a party to these Terms shall have the right to enforce any term of these Terms under the Contract (Rights of Third Parties) Act 1999.
